Ferrari has officially regained the rights to the iconic “Testarossa” trademark in the European Union. The EU General Court overturned a previous 2023 EUIPO decision that had revoked the mark due to lack of use between 2010 and 2015.The court found that Ferrari had continued to make valid use of the name through the resale of used vehicles via its official dealer network, its “Classiche” certification program for vintage cars, and the sale of genuine spare parts and scale models. All these activities were deemed sufficient to demonstrate genuine commercial use of the trademark.This ruling strengthens protection for heritage brands and confirms that secondary market activities can qualify as “genuine use” for maintaining trademark rights.
